Overview
The Blues Club is a membership section of the website The Happy Bluesman (www.happybluesman.com). It contains online courses, downloadable resources and other tools to help blues guitarists improve their playing.
Use of The Blues Club, including all materials presented herein and all online services provided by The Happy Bluesman Team is subject to the following Terms and Conditions. These Terms and Conditions apply to all members of The Blues Club.
By using The Blues Club, you agree to these Terms and Conditions, without modification, and acknowledge reading them.
Use of The Blues Club
To access The Blues Club, you must be 18 years of age or older and have the requisite power and authority to enter into these Terms and Conditions. Children under the age of 18 are prohibited from using The Blues Club, except in the case where written permission has been provided by a parent or guardian.
In order to use The Blues Club, you will be required to provide information about yourself including your name, email address, username and password, and other personal information.
You agree that any registration information you give to The Blues Club will always be accurate, correct, and up to date.
You must not impersonate someone else or provide account information or an email address other than your own. Your account must not be used for any illegal or unauthorised purpose.
You must not, in your use of The Blues Club, violate any laws in your jurisdiction.
Lawful use of The Blues Club
You may use The Blues Club for lawful purposes only. You agree to be financially responsible for all purchases made by you or someone acting on your behalf through The Blues Club.
You agree to use The Blues Club and to purchase services or products through The Blues Club for legitimate, non-commercial purposes only.
You shall not post or transmit through The Blues Club any material which violates or infringes the rights of others, or which is threatening, abusive, defamatory, libellous, invasive of privacy or publicity rights, vulgar, obscene, profane, or otherwise objectionable, contains injurious formulas, recipes, or instructions, which encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any law.
Refusal & deletion of membership
Membership to The Blues Club is offered subject to our acceptance of your order or requests.
We reserve the right to refuse membership to any order, person or entity, without the obligation to assign reason for doing so.
Further, we reserve the right to remove and delete accounts held by any individuals representing companies that offer a similar or directly competing Membership, or to remove and delete any member of The Blues Club that is in violation of the terms outlined in this agreement in full.
No order is deemed to be accepted by The Happy Blues Club until payment has been processed.
Order confirmation
Once you sign up to The Blues Club, we will email you to confirm the placement of your order and with details concerning product delivery and ongoing payments.
In the event that there is an error in this email confirmation, it is your responsibility to inform us as soon as possible. You can send a message through the messaging system in The Blues Club or via email to aidan@happybluesman.com.
Duration of membership
Once your order has been confirmed, we will provide you access to the purchased membership.
You agree and understand that access to The Blues Club may at times be influenced and affected by third parties that we use to provide The Blues Club (web hosting, video software platforms, plugins etc.).
If you are paying monthly for your subscription, you are granted access to The Blues Club for 30 days. Failure to pay your monthly subscription payment will result in access to The Blues Club being stopped.
If you are paying annually for your subscription you are granted access to The Blues Club for 365 days.
You can cancel the automatic renewal of your annual subscription at any time and your access to The Blues Club will end at the end of the current contracted term.
Cancellations & refunds
Within your first month of membership, should you feel that The Blues Club is not for you, we offer a 30 day money back guarantee.
To request a refund under the guarantee please cancel your account via your account page and mention it in the comments, or email aidan@happybluesman.com.
This 30 day refund period only applies to your first month of membership and only to the first subscription. It cannot be used more than once.
Outside of the 30 day guarantee, you can cancel your monthly subscription at any time via your account page. However due to the nature of The Blues Club, you will not receive a refund for membership fees already paid.
If you cancel your membership you will have access to The Blues Club until the end of your billing period. Following that date, you will lose access to The Blues Club. This includes access to all video courses, downloadable resources and support tools.
You will not receive a partial refund should you terminate an annual subscription to The Blues Club before your renewal date. You will however retain access to The Blues Club until the end of your annual payment term.
It is your responsibility alone to ensure that you cancel your account in good time should you no longer wish to be a member of The Blues Club and not wish to be billed further.
Price & feature changes
As further features, material and content are added to The Blues Club over time, the price may change and increase.
After you join The Blues Club, the cost of your monthly or annual subscription will reflect your price at the time of joining. If you join at a price of $10 per month, you will continue to pay that price for the remainder of your membership to The Blues Club.
However, if you cancel your membership to The Blues Club and wish to rejoin following a period of 6 months or more during which you have not been a member of The Blues Club, you will be subject to a new and potentially higher cost of The Blues Club.
The cost of the additional services outlined below and available within The Blues Club are also subject to change and may increase over time.
We may at any time change or discontinue any aspect or feature of The Blues Club, subject to us fulfilling our previous responsibilities to you based on acceptance of your payment.
Extra services
As part of the Happy Bluesman, members have the option to book extra services. This includes 1-2-1 online coaching sessions.
1-2-1 online coaching sessions
It is the responsibility of members that have booked this service to ensure they arrive at their session promptly. Members that are late to their sessions will lose that time and will receive no partial refund on the total session price. Cancellations within 24 hours of the session will be charged in full. Cancellations within 48 hours of the session will be charged at 50% of the session price.
Intellectual property of The Blues Club
The Blues Club contains intellectual property owned by The Happy Bluesman. This includes trademarks, copyrights, proprietary information, and other intellectual property.
The Happy Bluesman’s copyrighted and original materials are provided to you as part of The Blues Club for your personal use and enjoyment. You must not:
- Republish these materials without prior written consent
- Sell, rent or monetize these materials in any way
- Reproduce, duplicate, create derivatives, copy or otherwise exploit the materials in The Blues Club for any purpose
- Redistribute any of these materials onto another website(s)
This includes but is not limited to sharing material with others, posting excerpts of material on any social media, writing or blogging about the material, or any other activity that would reasonably appear to share
The Blues Club’s information with non-members. If you violate this policy, we reserve the right to immediately remove you from The Blues Club without refund.
All intellectual property, including downloadable resources remain the sole intellectual property of The Blues Club and The Happy Bluesman.
Material uploads
You shall not upload, post or otherwise make available on The Blues Club any artwork, photos, or other materials protected by copyright, trademark, or other proprietary right without the express written permission of the owner of the copyright, trademark, or other proprietary right, and the burden of determining that all such materials are not so protected rests solely with you.
You shall be liable for any damage resulting from any infringement of copyrights, trademarks, or other proprietary rights, or any other harm resulting from such a submission.
For all such materials submitted by you to The Blues Club, you automatically represent or warrant that you have the authority to use and distribute the materials, and that the use or display of the materials will not violate any laws, rules, regulations, or rights of third parties.
Liability
You agree that under no circumstances is The Blues Club or The Happy Bluesman liable for any direct, indirect, incidental, consequential, special, punitive, exemplary or any other damages arising from your use of The Blues Club.
Severability
Each clause, sub-clause and paragraph of these Terms of Service operates separately.
If any court or competent authority decides that any of them are unlawful or unenforceable, the remaining clauses, paragraphs or sub-clauses will remain in full force and effect.
Amendments
We may at any time amend these Terms and Conditions. Such amendments are effective immediately upon notice to you by us posting the new Terms and Conditions on www.happybluesman.com.
Any use of The Blues Club by you after being notified means you accept these amendments. We reserve the right to update any portion of The Blues Club, including these Terms and Conditions, at any time.
We will post the most recent versions to www.happybluesman.com and list the effective dates on the pages of our Terms and Conditions.
Summary
This Agreement constitutes the entire agreement between you and The Happy Bluesman pertaining to The Happy Blues Club and supersedes all prior and contemporaneous agreements, representations, and understandings between us.
